Terms of Service

ADU Home List is a directory and introduction service. We do not design, manufacture, finance, sell, install, or inspect ADUs, and we are not an agent, broker, contractor, or fiduciary for any user.

Any agreement you reach with a business you find through the Site — including pricing, scope, deposits, permits, timelines, warranties, and dispute resolution — is solely between you and that business. We are not a party to it and are not responsible for performance, quality, licensing, insurance, or payment under it.

Listings, profiles, specifications, prices, service areas, and credentials are supplied by the businesses themselves. We do not independently verify them. Verify licensing, insurance, and references directly with the business and with the appropriate authority in your jurisdiction before entering into any contract or making any payment.

You must be at least 18 years old and able to form a binding contract to use the Site. The Site is not directed to children.

You may create an account with an email address and password, or by signing in with Google. You are responsible for the accuracy of your account information, for keeping your credentials confidential, and for all activity under your account. Tell us promptly at support@aduhomelist.com if you believe your account has been accessed without your authorization.

If you register on behalf of a company, you represent that you are authorized to bind that company to these Terms. Business accounts may be managed by more than one user; an account owner is responsible for the actions of the users they grant access to.

You retain ownership of the content you submit — business profiles, floor plan listings, photos, galleries, brochures, CAD and plan files, renders, videos, articles, reviews, and messages (“Your Content”).

By submitting Your Content, you grant ADU Home List a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt for display, and publish it for the purpose of operating and promoting the Site and the marketplace. This licence ends when you delete the content or your account, except for copies retained in backups or where we must keep records to comply with law. Files you mark or upload as private are served only through an authorization check and are not published publicly.

You represent that you own or are licensed to submit Your Content, that it does not infringe anyone's rights, and that listings accurately describe what you actually offer — including price, dimensions, specifications, availability, and service area. Keep listings current and remove them when they are no longer available.

We may remove, decline to publish, unpublish, or edit content that violates these Terms, that we reasonably believe to be inaccurate or unlawful, or that may harm users or the Site.

Reviews must reflect your own genuine experience. You may not post a review of a business you own, control, or work for, exchange anything of value for a review, post on behalf of someone else, or submit reviews intended to inflate or damage a rating.

Reviews must not contain unlawful, defamatory, harassing, discriminatory, or obscene material, other people's personal information, or confidential contract terms.

Businesses may publish one official reply to a review of their own listing or profile. Reviews and replies may be reported for moderation, and we may remove, reject, or hold content that breaches this section. Reviews are opinions of the people who wrote them and are not endorsements by ADU Home List.

You agree not to:

• Use the Site for any unlawful, deceptive, or fraudulent purpose, or to misrepresent your identity, licensing, or affiliation.
• Scrape, crawl, harvest, or bulk-download listings, profiles, images, or contact details, or use the Site to build a competing database.
• Send unsolicited commercial messages, spam, or chain solicitations through the Site's messaging or inquiry forms.
• Upload malware, attempt to bypass authentication or access controls, probe or test the Site's security, or access data you are not authorized to see.
• Interfere with the operation of the Site, impose unreasonable load on it, or circumvent usage limits such as listing or boost capacity.
• Infringe intellectual property or publicity rights, or post content you do not have the right to post.
• Collect or use another user's personal information for any purpose other than responding to their inquiry about an ADU product or service.

Businesses may purchase a paid membership that sets how many floor plan listings they may publish and how many listings they may boost at one time. Add-ons may be purchased to raise either limit.

Boosts are a concurrent capacity, not a consumable credit. Boosting a listing occupies one of your boost slots for as long as the boost is active; removing a boost frees that slot again at no charge. Your plan does not include a bank of single-use boosts.

Boosting and featuring improve placement and visibility within the Site. They do not guarantee any number of impressions, inquiries, leads, calls, or sales, and we make no representation about results.

If your membership is downgraded, lapses, or is cancelled, listings and boosts in excess of your remaining capacity may be unpublished or unboosted automatically.

Payments are processed by Stripe. We do not receive or store your full card number; Stripe handles card data under its own terms and privacy policy.

Paid memberships and add-ons are billed in advance on a recurring basis at the price and interval shown at checkout, and renew automatically until cancelled. By subscribing you authorize recurring charges to your payment method.

You may cancel at any time from your subscriptions page. Cancellation stops future renewals and takes effect at the end of the current billing period; access and capacity continue until then. Except where required by law, fees already paid are non-refundable and partial periods are not prorated.

If a payment fails or is reversed, we may suspend paid features, unpublish listings, or close the account. Prices and plan contents may change; we will give notice before a change applies to your next renewal. Taxes, where applicable, are your responsibility.

ADU Home List is not a lender, mortgage broker, loan originator, or financial adviser. Rates, payment estimates, loan product descriptions, and lender listings on the Site are general information only and are not quotes, offers, commitments to lend, or advice.

The loan calculator is an illustrative tool. See the Loan Calculator Disclaimer for its specific limitations, which form part of these Terms.

The Site relies on third-party services to work — including Stripe for payments, Google for optional sign-in and webfonts, Resend for email delivery, OpenStreetMap/Nominatim for geocoding addresses, and YouTube and Vimeo for embedded video. It also links to and embeds content from businesses and other sites.

Those services are governed by their own terms and privacy policies. We do not control them and are not responsible for their content, availability, or practices.

The Site itself — its software, design, text, graphics, logos, and the compilation and arrangement of its listings — is owned by ADU Home List or its licensors and is protected by intellectual property law. Nothing in these Terms transfers those rights to you.

You may view and use the Site for its intended purpose. You may not copy, reproduce, distribute, modify, reverse engineer, or create derivative works from it except as these Terms allow or the law permits.

If you believe content on the Site infringes your copyright, contact us at support@aduhomelist.com with enough detail to identify the work and the material in question, and we will review it.

The Site is provided “as is” and “as available”. To the fullest extent permitted by law, ADU Home List disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Site will be uninterrupted, secure, or error-free, that defects will be corrected, or that any listing, profile, specification, price, rate, availability, credential, estimate, or review is accurate, complete, current, or suitable for your circumstances. Building an ADU is subject to local zoning, permitting, and code requirements that only your local authority can determine.

To the fullest extent permitted by law, ADU Home List and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost business, lost data, or construction delay or cost overrun, arising out of or relating to your use of the Site — even if we have been advised of the possibility.

Our total aggregate liability for all claims relating to the Site is limited to the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or USD $100.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the exclusions and limitations above apply only to the extent permitted, and nothing in these Terms limits liability that cannot lawfully be limited.

You agree to indemnify and hold harmless ADU Home List from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of Your Content, your use of the Site, your breach of these Terms or of any law, or any dispute between you and another user or business.

You may stop using the Site and close your account at any time by contacting us.

We may suspend or terminate your access, remove content, or unpublish listings — with notice where practicable — if you breach these Terms, if your payment fails, if we are required to by law, or if we reasonably believe your use harms other users or the Site.

Sections that by their nature should survive termination do so, including the content licence as it applies to content already published, fees owed, disclaimers, limitation of liability, indemnification, and governing law.

We may update these Terms as the Site changes. When we do, we will revise the “Last updated” date above, and for material changes we will give reasonable notice — by email or a notice on the Site — before they take effect. Continuing to use the Site after a change takes effect means you accept the revised Terms.

These Terms are governed by the laws of the State of [STATE], without regard to its conflict-of-laws rules. You and ADU Home List agree to the exclusive jurisdiction of the state and federal courts located in [STATE] for any dispute arising out of these Terms or the Site, except that either party may seek injunctive relief in any competent court.

Before filing a claim, please contact us at support@aduhomelist.com so we can try to resolve the matter informally.

If any provision of these Terms is held unenforceable, the remaining provisions stay in force. These Terms, together with the Privacy Policy, the Cookie Notice, and the Loan Calculator Disclaimer, are the entire agreement between you and ADU Home List regarding the Site.
